Under Delaware’s Alcohol and Tobacco Enforcement, servers and sellers of alcohol must undergo a Responsible Server Training course approved by the state. In other words, if you want to tend bar in Delaware, it is a LEGAL REQUIREMENT that you successfully pass a state-approved server training program.

What is actually the Servers Responsibility?
When an individual becomes licensed to serve and sell alcohol, they are taking on a tremendous public responsibility: the responsibility to serve alcohol responsibly. Although some states have Dram Shop Laws, note that Delaware at this time does not. The state does have Civil/Tort Statutes which can, theoretically be used to hold servers responsible.
It’s important that servers recognize that a failure to exercise their duty to comply with the laws and regulations of the State of Delaware can have consequences far more serious than an appearance in criminal court and the imposition of a fine. It could, in fact, become a full-blown civil litigation, with the risk of a judgment containing punitive damages in a substantial amount.

In July 1991, House Bill #65 was passed in Delaware which requires training for serving alcohol in the state. The training is conducted by the Division of Alcohol & Tobacco Enforcement at least once a week in each county.
